Court upholds lease extension for Diablo Canyon Power Plant

LOS ANGELES (AP) – A California appeals court has upheld a lease extension for California’s only nuclear power plant.

A division of the 2nd District Court of Appeal on Wednesday rejected claims that the state lands commission should have conducted a thorough environmental review before deciding whether to extend the lease of the Diablo Canyon nuclear power plant in San Luis Obispo County.

The commission in 2016 determined the lease extension was exempt from environmental review and allowed Pacific Gas and Electric Co. to continue operating Diablo Canyon through August 2025, when the utility plans to shut the plant down.

The environmental group World Business Academy argued that the extension of the plant’s lease presented unusual circumstances, including the possibility of a devastating earthquake.

A message for the group’s founder was not immediately returned.
